PLEASE READ THESE TERMS OF USE (“TERMS”) CAREFULLY. BY ACCESSING OR USING OUR SITE AND ONLINE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND ALL TERMS DEFINED HEREIN. DO NOT USE OUR SITE AND SERVICES IF YOU DO NOT AGREE TO ALL THESE TERMS. This Site is not intended for use by anyone under the age of 13. By using the Site, you represent and warrant that you are over the age of 13 – if you are under the age of 13, DO NOT ACCESS, USE OR REGISTER FOR AN ACCOUNT ON THE SITE.

1. PRIVACY POLICY.

Please review the Puget Consumers Co-op (“PCC”) Privacy Policy to understand how we collect, use and share information about you.

2. OWNERSHIP OF SITE CONTENT; SITE LICENSE.

This Site and the information contained in it, including but not limited to images, logos, trademarks, design and text (“Site Content”), are the proprietary property of Puget Consumers Co-op (“PCC”) and in some cases our licensors, vendors or suppliers, and are protected by copyrights, trademarks, service marks, patents, or other intellectual property rights, and by U.S. and international laws. “PCC”, the “PCC Community Markets” logo and other PCC service names, slogans and marks that may appear on the Site are trademarks or registered trademarks of PCC and may not be copied, imitated or used, in whole or part, without PCC’s prior written permission. Photos contained on our Site are protected by copyright law and may not be copied or used without the prior permission of the copyright holder, which may be PCC or a third party. The look and feel of the Site, including graphics, layout, page headers, icons and scripts, constitute service marks, trademarks or trade dress of PCC and may not be copied, imitated or used in whole or part without our prior written permission. Reference to any product, manufacturer, supplier, service or process on the Site does not constitute an endorsement by or recommendation of PCC.

You are granted a limited, non-exclusive, non-sublicensable, revocable license to access and use the Site for personal, non-commercial purposes, strictly in accordance with these Terms. Your license is subject to your compliance with these Terms and does not include the right to engage in (a) any resale or commercial use of the Site Content; (b) the distribution or public display of Site Content; (c) modifying or making any derivative use of the Site Content or any portion thereof; (d) use of any data mining or similar data gathering methods; (e) downloading any portion of the Site, except as expressly permitted; or (f) any use of the Site or Site Content other than for their intended purpose.

You are granted a limited, non-exclusive right to create a hypertext link to this Site, provided it is a text-only link which points to one of our domain names, and which displays the Site “full-screen” and not within a “frame” on the linking Web site. Further, the appearance, position and other aspects of any link to this Site must not be such as to damage or dilute the goodwill associated with our name, trademarks, and service marks, create the false appearance that we are associated with or sponsor the linking Web site, or present PCC Community Markets in a false, misleading, derogatory, or otherwise defamatory manner. This limited right may be revoked at any time without notice and in our sole discretion.

Any use of the Site or Site Content outside of the scope of the license granted in these Terms without the prior written consent of PCC is strictly prohibited and will result in termination of the granted license and PCC’s exercise of any and all rights granted to it in law or equity. Nothing in these Terms shall be interpreted as granting any license or right to any intellectual property contained in the Site Content, whether by estoppel, implication or otherwise, and the granted license is revocable at the sole discretion of PCC at any time.

3. SITE REGISTRATION.

In order to utilize certain functionality of the Site, you must complete a registration process. During this process you will provide an email address and set a password for your registration. Please keep this password secure and confidential.

In consideration for the license granted to you to use of the Site, you agree to: (a) provide true, accurate, current, and complete information about yourself as requested by the Site registration form (“Registration Data”), (b) maintain and update such information timely, (c) maintain the security of your account credentials and not share such with others, and (d) promptly notify PCC if you discover or believe there has been a security breach related to your account or the Site.

By registering, you consent to the collection and use of your data, including, without limitation, Registration Data, in accordance with our Privacy Policy.

4. WARRANTY DISCLAIMER.

THIS SITE AND ALL SITE CONTENT, INCLUDING PRODUCT DESCRIPTIONS CONTAINED ON THIS SITE, ARE PROVIDED ON AN “AS-IS”, “WITH ALL FAULTS” BASIS WITHOUT REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESSED OR IMPLIED. PCC EXPRESSLY DISCLAIMS ALL OTHER REPRESENTATIONS, WARRANTIES, CONDITIONS AND DUTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, USE, RESULTS, TITLE AND NONINFRINGEMENT.

5. LIMITATION OF LIABILITY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PCC, ITS TRUSTEES, EMPLOYEES, OFFICERS, MEMBERS OR AGENTS (“PCC PARTIES”) HAVE LIABILITY WHATSOEVER FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF DATA OR LOSS OF PROFITS, WHETHER IN ANY ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE ARISING FROM OR CONNECTED WITH YOUR ACCESS TO OR YOUR USE OF THE SITE OR ANY SITE CONTENT.

The Site Content, the Site and/or any linked sites may contain errors, omissions, viruses, problems or other limitations, and PCC does not warrant, nor shall it have liability whatsoever for your use of any Site Content, access to the Site or access to or content of any linked sites except as provided in these Terms. Linked sites are not under PCC’s control and the links are provided solely for convenience. Our Terms do not govern linked or other sites mentioned on the Site – you should review the privacy policies and terms of use for other sites you navigate to using links in the Site.

PCC IS NOT LIABLE FOR DAMAGES RESULTING FROM EVENTS BEYOND ITS REASONABLE CONTROL, INCLUDING INTERRUPTIONS OF THE SITE, DELETION OF FILES, ERRORS, OMISSIONS, VIRUSES, DEFECTS, DELAYS IN OPERATION OR FAILURE OF PERFORMANCE, REGARDLESS OF CAUSE. TO THE FULLEST EXTENT OF APPLICABLE LAW, IN NO EVENT SHALL THE AGGREGATE LIABILITY OF PCC PARTIES JOINTLY, ARISING FROM YOUR USE OF INABILITY TO USE THE SITE, EXCEED $50.00 USD.

THIS SITE AND THE PRODUCTS, INFORMATION AND CONTENT PRESENTED HEREIN WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS TO PCC’S LIABILITY.

6. PRICES OF PRODUCTS AND SERVICES ON THE SITE.

Prices of products and Services and promotions posted on this Site, or distributed by PCC in other media, are shown in US dollars; taxes, handling charges and other fees are additional. Prices and promotions are good only for the dates, conditions and products specified, and only in the particular store or stores indicated. All products are subject to availability and PCC reserves the right to impose quantity limits and to discontinue products at any time. Purchases for resale are prohibited. In the event of an error in prices or promotions, PCC reserves the right to correct the error, which may include changing the price of products. Your sole remedy is to not purchase the product.

7. PRODUCT INFORMATION; DISCLAIMER.

While PCC strives to provide accurate product descriptions as part of the Site Content, we do not warrant that any product information is error-free. While we work to ensure that specific product information is correct, on occasion manufacturers may alter their ingredients or source of manufacturing without informing PCC. Actual product packaging and materials may contain more and/or different information than that shown on our Site. For these reasons you should not rely on the information presented in Site Content, but should always read labels, warnings, and directions before using or consuming a product. For additional information about a product, please contact the manufacturer. Neither PCC nor the manufacturer assumes any liability for inaccuracies or misstatements about products.

9. USER CONTENT; GRANT OF LICENSE TO USER CONTENT.

In interactive areas of the Site, if any, you may post comments and communicate with us. Any information, photos, comments or other materials you post or use to communicate with us is referred to as “User Content”.

You are solely responsible for your User Content – PCC assumes no responsibility for User Content. PCC has no obligation to screen User Content but reserves the right in its sole discretion to remove any User Content at any time for any reason without notice. You specifically agree, with regard to your User Content:

  1. to abide by these Terms in all respects;
  2. only to post User Content that is relevant to and appropriate for the specific topic to which it is posted, and supports PCC’s mission of inspiring people to care about food, wellness, cooperation, education and the environment;
  3. only to post User Content that (i) you own, or (ii) you are posting with the owner’s express consent;
  4. that no User Content you post will infringe on the rights of others;
  5. not to post any User Content that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive or otherwise objectionable, that encourages conduct that would violate any laws or in violation of these Terms;
  6. to refrain from posting your or other persons’ personal information or from soliciting personal information from any user;
  7. not to post User Content that constitutes advertising or solicitation of your personal business or services;
  8. (i) not to interfere with or disrupt the Site or servers or networks connected to the Site, (ii) not transmit User Content that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of the Site, any computer software or hardware or telecommunications equipment, and (iii) not circumvent or disable any security or data-protection measures implemented on the Site.

By submitting User Content, you grant to PCC a nonexclusive, royalty-free, perpetual, irrevocable, world-wide right and license to use, copy, modify, publish and distribute your User Content in any format or media now or hereafter existing, for any purpose, including the promotion of PCC’s services, and without compensation to or further permission from you.
